Interactive Session on Triple Talaq Judgement by Supreme Court of India

We thank all the dignitaries who took part in the symposium to enlighten the young minds and to bring the nitty and gritty of litigation to the students of whom, many said that they are were interested to pursue litigation as a career. The symposium was highly fruitful and thus, Amicitiam delivered another contribution from it's side to the development of the youth and society.

Former CJI Khehar asked the government to bring legislation in six months to govern marriage and divorce in the Muslim community. The ball is now in Parliament's court. It is to be noted that the Centre had during the course of hearings earlier this year told the bench that it will come out with a law to regulate marriage and divorce among Muslims if 'Triple Talaq' is held invalid and unconstitutional by the apex court. Now the government might start framing the law to regulate Muslim divorce.

The five-judge bench of the Supreme Court declaring the practice of unilateral divorce (also known as triple talaq or talaq-e-biddat) unconstitutional, it is now unequivocally established that the practice – which runs counter to the gender jurisprudence evolved by the Supreme Court, the principles of equality as ordained in the constitution, international human rights law and the Quran – is not fundamental to the religion of Islam in India.
